Classes of Property

Modes of Acquiring Ownership
Ownership may be acquired by occupation, donation, succession (inheritance), prescription, and sale/tradition.
Sale alone does not transfer ownership โ delivery (tradition) does.
Co-ownership & Condominium
Co-ownership exists when several persons own a thing pro-indiviso. The Condominium Act (RA 4726) governs condo ownership and common areas.
Foreign Ownership
Foreigners generally CANNOT own land in the Philippines, but may own condominium units (up to the 40% foreign cap of a project).
